Kingston Council does not have authorisation to use its bus lane cameras to issue fines, according to one campaigner
Phillip Morgan says cameras need to be validated by the secretary of state according to a 1996 law, which hasn’t happened in the borough. He claims, that with this information, tribunals are being won “as a matter of routine”. Police still have the power to issue fines for the offence in Kingston.
Kingston Council says: The Council is authorised by Section 4 of the London Local Authorities Act 1996 to issue PCNs where it has reason to believe a bus lane contravention has been committed on the basis of information provided by the use of a prescribed device namely a camera designed or adapted to record the presence of a vehicle on an area of road which is a bus lane or a route for use by buses only. The Council says it does not comment on individual cases appealed to the Parking Adjudicator.
