Planning permission for the 20 metre structure behind the parade of shops in Kingston Road was obtained by EE.
But residents in Timbercroft claim it was put up without consultation, which is something Epsom and Ewell Borough council denies.
Homeowner Diane Cassell says it will devalue many properties and they will take legal action if it’s not moved.
